in the state rhode island can an ex spouse who still had access to a joint banking account and a joint savings account have the accounts closed and take all of the monies in these accounts? the divorce has been final for over one year but there were motions pending and final resolution did not occur until october of this year. a court order was filed with stipulation that no party owed either party any monies or property and within 24 hours after the order the ex spouse requested all of the funds from the bank and had the accounts closed. the ex spouse lives in another state and did this via the mails. why was the account not closed out? this was due to a court decree that said no properties can be disposed of until settlement which occurred the day before my ex spouse removed the funds. basically my ex acted in contravention of the court decree.. there were no funds in the account other than my paychecks which were direct deposited. of course this is being followed up by me with a motion to adjudge in contempt as a civil matter but my questions now involve the potential criminal nature of my ex spouse's actions. first question. is this a criminal act? my ex spouse had no rights to any funds in either account. my ex spouse merely had access to them. we were legally divorced for over a year and specifically agreed upon no monies in question or owed. second question: is this a felony since the total amounts were over $4,000.00 third question. is this an interstate issue since my ex spouse lives in another state and used the mails to facilitate the events? the local police seem reluctant to persue this as a criminal act since my ex spouses name was on the accounts and my counterpoint to this is simple. if a person has access to something i.e. if you have someone in your home and you leave your wallet on a table, and they knowingly remove monies from this wallet is this not of the same nature? they had access yet no right or permission. i am pretty sure that anyone caught doing such a thing could be prosecuted. at any rate i look for thoughts from the internet at large, thanks

You can't close it without hers. She can withdraw money if her name is on the account and it's a joint account. If you want to keep using PayPal, pay off the balance in your PayPal account by transferring money from another account - and do it quick before PayPal decides you are trying to commit some sort of fraud (they have a 'hair trigger' for this sort of thing) and freezes your account for 6 months.

As a customer service rep, I am sorry to hear about your frustration regarding your student loans. Since I am not at work right now, I can speak my mind and give my personal opinion. You may want to become acquainted with the Better Business Bureau if you have not thought about that before. Allow me to introduce you (see links below). You may want to consider filing a complaint with the Better Business Bureau. You would have to explain the details in detail (literally), but you would get your problem resolved promptly. If you have the proof (receipts, invoices, etc.) to show that the bank completed a double transaction, they will request that for resolution purposes. If the bank is doing this to you, it's highly likely that there are other customers that have experienced similar frustrations. Sure, there are periods of time when companies get busy and you may not get the immediate answer that you want, but reasonably, something should have happened within two weeks or so. You had stated that your loan payment was in October. This is now January...they should be getting a move-on AND I don't blame you for wanting to take your business elsewhere. i opened a cd a year ago by transferring money online from my bank to gmac which is now ally. my cd matured and i closed my account at $5,142. i waited over a week for the check to arrive and called them asking where it is. they said it was mailed on the march 26th. it's now april 3rd, 8 days for it to arrive in the mail. when i called they asked me if i wanted to stop payment or wait. i was livid when they said there would be a charge for a stop payment. i'm yelling at her by this point. i can send them money safely online, and they have no way of sending it back online, only through the mail. i cannot believe this, i really cannot. i think this is a scam. by an fdic insured bank. they close my account, cut me a check, then shrug their shoulders. when i demanded to speak with the manager, i got a giggling lady who was more concerned with asking me how my easter was going to be than to help me out. i got no help from here. no suggestions. she just said the "resolution team would call me". i think she thought the whole thing was funny. now i think i'm getting the run around. i don't know what the hell to do. i'm so mad i cannot see straight. well, my check came today. it took a long time, but it did arrive. i sort of feel bad for yelling at them, but it's not all my fault. they should communicate when the check is being mailed, and also have an online transfer like all banks have these days. just for the record ally did come through on the principle/interest they owed me. however their customer service can use some improvement.

Corey I would not panic yet. They probably use a secure pail site and could take an extra day or two. I would be concerned if it did not arrive by Tuesday. Did you check the address that it was mailed to? If it is lost, contact their Customer Dispute section. You will not have to pay for the Stop Payment.... but, the re-issuance is a regulated transaction... and a replacement will not be forthcoming. It would be much better if the check arrives late rather than lost! If you decide to place the stop, and it does arrive, you can remove the stop... but, wait a few days before cashing it in. It takes time to both place and remove the stop. Again, better o wait! Good Luck Soccerref

IF your PC (or your Bank or Credit card number) has been used with an other seller account, then this may be 'for real'.... HOWEVER a common 'phishing' (fake) email is to pretend your account has a problem and then give up a 'link' to click on .... needless to say, if you click on any link in an eMail, you WILL get your account details stolen (if you did, go to a different computer, log in again and change your passwords NOW ... you also need to get advise on how to remove any fraudulent 'bookmarks' or other infection of your Browser) All you can do is wait for the 14th and see if your money is released .. if it is not, and you have been unfairly 'related' to some previous account, go to the Amazon web site and complain (DO NOT click on any 'link' in any email ..) NB. you can report fake emails to Amazon at the email address: stop-spoofing@amazon.com

my wife is being ripped off by nationwide bank. about a year ago she needed to use her overdraft facility which she had used on many occasions prior to this. she went about £20 overdrawn. the bank then started issuing fines saying she did not have the overdraft any more as she is supposed to formally renew it every year in writing. she was never told this. we argued this for a while both in the branch and in writing but to no resolution. in the process they issued more and more fines and she ended up £90 overdrawn so we just decided to pay it in cash and close the account. however they refused to close it saying since we wrote the letter and settled the balance more fines were issued so she now owes more money. the fines have been coming fast since then and they are now saying that it is out of there hands and has been passed on to the courts. can anybody give me any advice and i would like to know of ways i can let as many people know about this as possible i.e. good websites etc misskitty7... that is simply not true. i have had the same overdraft with my bank for over 10 years and have never once renewed it.

Q. Paypal claim against me help!?
so i have a buyer claiming an item significantly not as described against me, and its not a claim on paypal. of course the transaction was through paypal, but since then i have transferred all the funds to my bank account and closed my paypal account. i am getting emails to the paypal email address i used telling me to go to resolution centre etc but i cant, i closed my account! i cant log in it says user not on system. so what do you think paypal can do? i have no funds, and not even an account anymore! it doesnt make sense that i can be involved in a claim when i have since cancelled my account, anyone have any idea what might happen? sorry should have said is now a paypal claim instead of not.

You need to resolve the dispute. I believe since you have a bank account tied to your paypal account, they can go into it to retrieve funds, even though you have closed the account. Did you close the account hoping this would keep the person from getting a refund? You also don't say whether the item sold actually was not as described. This would lead me to believe you were trying to rip off the buyer and if that is the case, I hope they are successful in getting the money back. You could have an actual lawsuit filed against you if you continue avoiding the person who has filed the claim through PayPal.

paypal is fcked up!!!!!!!!. always awarding the buyers. i sold a new laptop to a person in australia for 1.2k with signature comfirmation. the item was delivered and signed. the buyer filed a claim claiming he did not get the item. he got a full refund because paypal claimed that he did not get the item. paypal told me i cannot file a claim on the insurance because the item was delivered and signed. if it was delivered, why did that person get a full refund? wtf is that!!!! that's fcked up
